A 67-year-old retired nanny settled her lawsuit against a Chicagoland hospital regarding medical negligence that resulted in a perforated bowel, right ureter injury, and injury to the vasculature of her right kidney. On February 11, 2018, Plaintiff had a CT of the abdomen done at Defendant Hospital that showed a horseshoe kidney. A horseshoe kidney is a congenital condition that causes the kidneys to join and form a horseshoe shape. In June 2018, Plaintiff had a Lasix renal scan done at the which demonstrated that her right kidney accounted for 97% of her kidney function. On July 24, 2018, the plaintiff went into defendant hospital to have her left kidney removed. During the surgery, the surgeon failed to appreciate the presence of the horseshoe kidney and failed to protect the dominant right kidney. During the surgeon cut the right ureter, injured the vasculature of the right kidney, and perforated the Plaintiff’s bowel. As a result of defendants’ medical negligence, Plaintiff needed a much larger incision, a bowel resection, and a stent in her ureter. Plaintiff’s kidney function stabilized and was normal at the time of her discharge from the hospital. Plaintiff continues to have a stent in her right ureter and has required a few stent exchanges. $1,000,000 was paid by the self-insured hospital. David J. Gallagher and Brian Fetzer represented the patient.
