A settlement was obtained on behalf of an 80-year-old male, where there was a delayed diagnosis of his lung cancer. In August of 2021, the plaintiff was at his primary care physician’s office who ordered a CT scan, which showed a lung nodule. Plaintiff was never told to get a repeat CT scan. In January of 2023, the plaintiff went to the ER for a suspected pulmonary embolism, and a CT scan was performed. The CT scan was reported as normal, and there was no indication that there was a lung nodule. In May of 2023, a repeat CT scan was performed because of hoarseness, which revealed lung cancer. Plaintiff has undergone surgeries, chemotherapy, and radiation, and is currently cancer-free.
