In June of 2015, a man with severe stenosis in his cervical spine underwent a surgical procedure to relieve pressure on his spinal cord and nerve roots. Instead of relieving the problem, the surgical procedure complicated his problems, resulting in severe and ongoing weakness in one of his arms. The defendants contested liability, claiming the outcome of the procedure was a known complication, about which the plaintiff had been properly informed.
The plaintiff was represented by Brion Doherty and Bradley Schulman.
