The family of a 12-year-old boy settled their lawsuit against a Chicagoland hospital regarding medical negligence that resulted in the death of their 12-year-old son. In February of 2017, the young boy had a witnessed code event while on the playground. His mother (who was present) performed CPR and was able to successfully resuscitate him. He was taken to a hospital and was given 24-hour cardiac monitoring and electrocardiogram. He was released without restrictions. He had a second episode in April of 2017 while at school and was taken via ambulance to a different hospital. From there his care was transferred to the defendant hospital where he was under the care of a cardiologist. A stress test was ordered at the insistence of the boy’s father. He was diagnosed with an arrhythmia caused by a potentially fatal genetic disorder and was prescribed 20 mg of Nadolol daily and was instructed to follow up with cardiology on an annual basis. As the boy grew from April 2018 to Feb. 22, 2019, his medication did not change. He died on February 22, 2019, due to a condition called Catecholaminergic Polymorphic Ventricular Tachycardia. The boy was survived by his mother, father, younger brother, and two adult step siblings. $2,000,000.00 was paid by the self-insured hospital. David J. Gallagher and Brion W.
