$1.1 Million Dollar Settlement Against Rush Physician

On September 27, 2012, defendant, Gary Schaer, M.D., was driving his vehicle to Rush University Medical Center where he is employed as professor of medicine.

At the intersection of North Park Avenue and North Avenue, Dr. Schaer failed to keep a proper lookout while executing a right hand turn from a stop sign and struck decedent, Marilyn Williams.

The decedent appeared to be yelling at defendant moments before impact occurred as she walked in front of Dr. Schaer’s vehicle while crossing North Park Avenue as a pedestrian.  The event was captured on videotape from a nearby apartment building.  The insurance company for the defendant, Allstate Insurance, paid its policy limits to resolve the lawsuit. The Honorable Edward Harmening entered an order approving the settlement and dismissing the case.  Robert J. Napleton represented the siblings of Marilyn Williams, a 67 year old retired school teacher.  The case is Williams v. Schaer, 12 L 14398.
